Instagram profile
1. Joint controller
IMAGICKS, represented by Viola Bergmann, Beihinger Str. 26, 71726 Benningen a.N., Germany, T.: +49 173 6893078, E.: info(at)imagicks.com uses the profile https://www.instagram.com/_imagicks_/ on Instagram. The Instagram service is a Facebook product provided by Facebook Ireland Limited (Facebook). Together with Facebook, we are joint controllers for data processing in connection with this profile pursuant to the provisions of Article 4(7) of the General Data Protection Regulation (GDPR).
When you visit my profile, Facebook and me as joint controllers process personal data concerning you. Please read this Privacy Policy carefully to understand the extent to which personal data concerning you (data) is processed.

2. Data processing: Purposes
a) Use of our Instagram profile
aa) Sharing and connecting
We use our Instagram profile to share and connect with the people who use or visit Instagram. From time to time we will share information directly with you about our company and associated service offerings such as events we have held/are holding, special promotions and service offerings, etc. If we share, comment on or like something you have posted on your Instagram profile, or if you decide to share, comment on or like something we have posted, your username and the data you publish on your profile may be displayed on our Instagram profile and made available to our followers.
bb) User analytics
My Instagram profile also enables me to receive statistics generated by Facebook on visits and visitors. These allow me to improve the targeting of my marketing activities. In doing so, I can sometimes discover Instagram profiles of individual users who like my profile and/or use page functions. This enables me to offer the users in question improved content and functions via my Instagram profile.
To further improve the content on my Instagram profile, I can also access demographic and geographic analyses based on the information collected during the user’s visit. This allows me to display targeted interest-based ads without gaining knowledge directly of your identity as a visitor.
If you use multiple devices to browse Instagram, collection and analysis can also be performed across devices provided you are logged in to your Instagram profile at the time you visit my profile.
I only receive anonymised user statistics. I am unable to access the underlying data.
b) Use of Insights and cookies
As part of my Instagram profile I use the Insights service provided by Facebook to receive anonymised statistical data about visitors to my page.
When you visit my Instagram profile, Facebook will place a cookie on your device. This cookie contains a code that can be associated with a user. Unless deleted beforehand, this cookie will remain active for two years. The user code can be linked with your information if you are a registered Facebook user. The resulting information that is stored will be processed by Facebook. It is also possible for third parties to use this information from the Facebook cookies to provide services to companies advertising on Facebook.

3. Lawful basis and legitimate interests pursued by us in processing data
Pursuant to Article 6(1)f GDPR, I process personal data on the basis of the legitimate interests pursued by me to engage effectively with users on Instagram, visitors to my profile as well as to communicate with users on Instagram and to promote my company.
4. Transfer of data
When visiting my Instagram profile, the data collected may be transferred to Facebook Inc. based in the USA and processed there.
I will never transfer data to third parties as part of my use of my Instagram profile.
5. Instagram account opt-outs
As an Instagram user, the marketing preferences settings in your Instagram account let you configure the extent to which I can record your behaviour when you visit my Instagram profile. 6. Joint controller arrangement
Given the existing agreements with Facebook, including in respect to the joint controller arrangement under the data agreement, it is best to assert requests for access as well as additional rights as a data subject towards Facebook directly. As the operator of Instagram, and with its ability to combine user profiles there, only Facebook is able to access the necessary information directly and take the necessary steps to provide access in a direct manner.
I am of course always ready to support you as well as to meet my obligations as a controller.

The YouTube service is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. In the following, we provide information about how I process data as part of my YouTube channel.
1. Data processed by us through your use of YouTube
I do not process any data directly when it comes to my YouTube channel itself.
However, if you have entered information as a registered YouTube user, such as your username, and published any content under your own account, I will process these data as follows:

In this case, the information you enter on YouTube, in particular your (user)name and the content published under your own account, will be processed insofar as they are included in my service offering and made available to my fans.

Pursuant to Article 6(1)f GDPR, I process personal data on the basis of the legitimate interests pursued by me to engage effectively with users on YouTube, visitors to my channel as well as to promote my company.
Insofar as visitors publish or transfer special categories of personal data such as in comments or private messages, etc., data processing will be based on this information having been made public (Article 9(2)e GDPR) or the explicit consent of visitors to data processing (Article 9(2)a GDPR).
3. Data processed by YouTube
YouTube processes the data collected concerning you through your use of its platform. This data may be transferred to countries outside the European Union. I have no influence over the nature and scope of data processed by YouTube, the manner of processing and use, nor the transfer of this data to third parties, especially in countries outside the European Union.

These data include information about your visits to websites and apps as well as interactions with advertisers.
By using cookies or similar technologies, it is also possible to record your visits to these websites and associate this data with your account to then offer you targeted content or ads.

5. Restricting the processing of personal data concerning you by YouTube
Your Google account settings allow you to check and update how your information is processed.

You can configure your browser to block all cookies, including the provider’s cookies, or to notify you as soon as a provider places a cookie on your device.
